Dear Sir/Ma'am,
I am working in Pharmaceutical MNC as first line manager since last 8 months and handles a team of 6 people.I wants to know that if any of my subordinate goes to HR dept and put false allegations on me about something which i haven't done and is strictly against company policy. What can be done?
Can i go to court and file defamation suit against that subordinate?? What are the options available?

Dear Sumit,
Please don't mind, on seeing your post, I wonder if you are really a manager and have such type of problem?
Anyway, don't you feel yours is a very silly idea in the capacity of a manager, if you propose to go to court against your own subordinate? If you don't try to convince your superiors/ HR department, you would be shunted out of your place much in anticipation of the court judgment.
If not committed any irregularity, as a manager, do you feel so crippled and handicapped that you are unable to handle your subordinate, who dared to make false complaint against you to the HR?

The answer depends upon the nature and gravity of allegations. Anyhow, no action defamation lies on the issue.

How do you know that your subordinate is publishing falsehood against you with the HR of the company? Is it your suspicion or acquired knowledge?
And if you are confident that you have not committed any wrong and not gone against the company policy, why do you fear? Wait for HR to ask you to explain and then you can explain your case.

I also second A S Bhat, does your HR has taken any action/any enquiry about the allegation made by your subordinates, or are you anticipating one. Before hand going to the court of law, do you assume any fruitful result. Last but not the least the forum is unaware of the gravity of the allegation made for which a defamation suit can be filed to the court of law.

First & foremost, YOU are the boss for those 6 guys.....NOT the other way round.
And like A S Bhat mentioned, on WHAT basis are you so sure/confident that your subordinate went to HR dept and put false allegations on you? Can you give more details about this aspect?
Has HR Dept checked with you about this complaint?
Or you heard from another team member?
Further, I am not sure on what basis do you THINK that going legal & filing defamation suit will resolve the issue.
While going legal is ALWAYS an option in ANY issue, it doesn't necessarily have to be the BEST solution.
Pl give more details about the issue so that members can suggest more actionable suggestions.
