Hi All,
I need services of a lawyer dealing in labour/civil matter in Delhi.
My previous employer has refused to settle my dues as per the appointment letter.
I have serious grievances against my previous employer- for misrepresentation of the job profile- unprofessional treatment during my tenure- not paying dues as per the appointment letter.
I think it is completely unethical to play with someone's career- I quit my job based on their personal assurances and now Iam struggling to get even my dues.
I have all the relevant proofs to substantiate my claim.
I will appreciate if you please help me in this matter.

3. Your date of resignation / retrenchment / termination: This week terminated on grounds of unsatisfactory performance

4. Details of Relieving letter: Termination on grounds of unsatisfactory performance

5. Your pay package details.: 1.5 Lacs plus/month

6. What is the nature of job given in Job Profile and what did you perform while on service.: Elaborated in the case

7. What was the wrong happened with your career.: Elaborated in the case

8. What was due and what was the reason given by your management / HR for non adherence.: Elaborated in the case

9. Type of Industry you got engaged.: FMCG

Well Mr. Naresh, after going through your case it looks either you landed in a bad culture or you could not adapt to the culture of the organisation.

Ideally you should have immediately looked for an exit.

Now, in my view you need to first:

1) send strong e-mail with necessary proofs, put pressure to release the dues.

2) If you don't get response then approach a good lawyer dealing in civil cases- send a legal notice. The lawyer will advise you as how much compensation can be claimed. In my view you can also press for damage in reputation by claiming that termination is unjustified, as you did some business.

3) Finally, if it doesn't work then approach civil- but be careful as civil case may take long time, also you need to pay court fees, legals fees etc.

At this moment, I advise you to focus on finding a new job and once you have that stability then you should file a civil suite. I guess you will have 3 years period to file civil suite.

The legal expert in the forum will guide you about proper procedure/cost/time etc and the accordingly you take a call.
