Hi,
I am working in IT industry. I was working with one of the reputed software company for 4 Years 284 days.
At the time of leaving, I have asked them about Gratuity payment. They have straight away rejected it, saying you have not completed 5 Years.
But after checking many citations of law and judgements, I found that person who has completed 4 years and 240 days of continuous service, are elligible for Gratuity.
I have shown reference to all those stuff and also shared Madras high court judgement (attached)

MADRAS HIGH COURT
WP NO. 2135 OF 1987
DECIDED ON 12.6.1996
Still company is refusing and sticking to 5 years completion.
I am about to complain to Labor commissioner of Pune. Could any one guide me for further process?
