Dear Seniors,
Need your help
As per our company policy the retirement age of an employee is 55 years & we have an employee who had completed his 55 yrs of age but still wants to continue & our company also wants to retain him. So kindly suggest me how we can keep him in our organization as a contractor or some other ways are there.

The management have the right to continue the employement of any employee beyond the retirement age. You need to issue an office order extending his services till 58 or so subject to his continuing with good health etc., No necessary to go for contract or consultant.
However wait for more suggestions from our learned friends also.

Going with the above Idea can be good and a company can do this it may influence other staff in your company and if the same case again arises for other employee then you need to go again the same way by extending period of services and it will be just like playing with the company rules. As through this, the bad message will go in the staff that they assume that company can change or do modification in any other rules too.

Also, you need to understand that at some day you have retire the employee even if you do not want and there may be many reasons for that. So, instead of continuing services of that employee you can give opportunity to some new employee and trained him well under his guidance.

It would be better to sign a contract with that employee for the defined period and then and ask him to train a new or other junior level employee and when the new person get trained you can promote the new person to take his place. But the contract letter and all the things should be done with mutual understanding.

Simply sign a contract with him. As he was a former employee no claims are likely. So no issue.

retired employee is taken backon contract, the terms of employeement differs and
a suitable terms and conditions of contract agree- ment is required to be made to suit the such
employment of persons in
future too.
