If worker meet with accident after 2 days joining only.
Can he eligible for medical benefit under esi act ?
Can his family eligible (if he death ) for pension ?
What is the first condition on us ,like file his dicleration form on first day of his joining or any other ?
Can eligible for such benefit even his contribution not filed for single day,as act apply from first day of joining?

If Accident happened in course and out of employment, victims is eligible for all benefits under ESI Act even if employed 2 days ago.Send Form 16 immediately to avail benefits.. In this case Sickness benefit is not applicable but disablement benefit is to be claimed which is 70% of the wages

Sir How we can prove that he is covered under ESI , i mean to say about not contribution paid under his account or no submitt online decleration form also ?

Employees are to be covered from the 1st day of employment,by on line registration.He is eligible for medical,disablement,dependents,funeral &rehabilitation benefits without contribution conditions.Other benefits are linked to contribution.

Dear Raju
The employee is deemed to be on the rolls of the Company from Day 1. No matter whether necessary form is filed or not. Even if is filed it will take effect from the date of his joining and NOT from the date of filing the Form. Hence he is eligible for benefits under the ESI Act.

There is three ways to give benefit to worker in case of partial/permanent disablement and death. One is through ESI and second is through WC Policy and third one is through Group accident policy. If you want to provide benefit to worker under Group accident policy then you have to show your worker wages more than 15000/- and taking worker as your staff.
