I have resigned from my job and has spent five years & 2 months in that company.
Am i eligible for the gratuity?
Also i have filled the form I of gratuity and submitted to the company one month ago. they are saying that we will provide gratuity on december. Would this be valid or they trying to delay?
What should i do here?
Also how the gratuity be calculated i.e based on last basic drawn or basic salary of individual year?
Please help.

Hi, This would be calculated as. Last drawn basic salary+DA (if any as per annexure)*15 days*No of years served/26. Regards, Harpreet

Please mention your number of years of service also to calculate.
you can do it yourself as well. Just add no of year in place of X below.
34550*15*X/26= answer. The maximum gratuity amount is limited to an amount of Rs 3.5 lac.

Hi, Max Gratuity Limit for the person who retires/resigns before 2010 is 3.5 lac. The ammendment made only after 2010 and increased the limit to 10 lac. Regards Harsha Shetty
