In our company a lady is working & her esic is deducted. Her husband is working some where else but his esic is not deducted as he is in a small company.
now the question is that his husband can avail medical facility on behalf of her. can she give her husband name for esic facility.. pl. suggest.

In ESI family members are normally convered. For Married - spouse nad childrens and for single- Mother and father can be covered. Gunjan

It all depends whether the said employee has declared the name of her husband in the ESI declaration form or not. Only if she has declared the name of her husband and also submitted the Post card size group phtograph with her husband.

Hi dear,
That lady is working employee in your company as her husband is working person (forget whether his ESI is being deducted or not, whether his company is regd. under ESI Act or not). Her husband is a self dependent as he is working in a company. He is working because he is over 18 yrs of age. As per ESI Act: as her husband is self dependent so he will not be covered under her company / Card, considering he is self dependent.
Further ESI Act says : (1) only dependent minors can be covered. (2) Majors (Adults) can be covered, if, they are over 60 yrs of age and are dependent of an employee who is covered under the Act. 3. Any dependent, who is retired, if availing medical benefits after his/her retirement can not be considered as dependent (on the lady who is working as employee).

1) There is no question of any practical or impractical issues.
2) This is only the answer, I tried to clear, as per HER question. And I replied to clear the issues considering that SHE is asking a practical / genuine question. Further, neither I am a lawyer nor referred any book - I replied per my practical knowledge.
3) Even if you are not agreed, definitely, you can go IMPRACTICAL. Becuase there are no boundation.
