Contractors engaged to execute the project work, employing more than 20 employees. Does not have PF registration number, who's responsibility is to register under the act ?
What are the repurcussions if Contractor is not complying with statuate.

dear
as principle employer you are responsible forPF contribution of contract workers.if contract does not have code ,which is of course his responisblity ,than you can deposit the same on your code.

Dear Sir/ Ma'm
I am working in an export house where around 500 employees works. We have 15 contractors and each one have his labor. We use to deduct both side PF amount from there side. But contractors are not ready on this condition , they are saying that on less then 20 workers PF is not applicable, when we have less then 20 workers then why u r deducting PF from over side. So kindly clear this condition, whether they can work in our factory without deducting PF or not.

secondly: we have 2 factory with separate premises but in one factory we are showing second ones one unit i.e. machine section. so, is this possible to show two factory in one premises.

hi Currently we r giving 20% bonus to our workers, it it posible to reduce it to 8.33%. Seconly pls provide me the process of bonus destribution. Regards Atif

If the contractor does not have more than 20 workes but in your company PF is applicable and then your company is responsible to deduct the PF and ESI on their behalf and deposit in the concerned department (Only In case if the contractor is not contributing their PF and ESI for their workers).

If you employ five contractors and of which two contractors have less than 20 workers then you cannot insist those two to deduct PF. From his view he is right. He cannot apply for the PF code in anticipation.
Similarly at the time of engaing a contractor, please mention all statutories to be followed. Any liability not complied by the contractor comes on the Principal employer. Many a time, Contract Labour Act is not strictly followed anywhere and principal employer is also not serious about this. The remedy is that you have to deduct and remit on behalf of them.
Again there is a headache. His staff who turned up this month may or may not trunup next month. You cannot collectively remit as group PF. So individual member registration and paper work is more. Anways, approach a consultant for more clarity, doesn't matter if it costs the company.

I am working in a limited company, from the starting of contract labour i.e. from last two years they had not apply for the PF code no. now i am going to apply the same is there any penalty for not applying till today and not contributing the pf contribution?? please note that all have license of more than 50 workers since last two years.

We have one unit from last 5 years in silvassa and now we are going to start other unit in same premises with new factory license. can we have required to obtain two PF codes for the same.

if contactor not reday to take new pf code no then what to do in below condition?
1. if he agree to deducted pf amount in his bill then which head we will fill the same amount in pf fund.
2. if we fill the amount in company pf code then which heading. the contractor worker not perment employee of company.
3. as per esic there is option for omited wages for fill the esic amount of other contactor worker. in pf that type any option available.
4. if we fill the contractor worker pf in company code then it may me in future they demend his pf then? also claim as company woker then?
