hi

I work in software firm in Noida. The company requires 1 month notice period or else salary in lieu of notice period (but if resignation accepted).
Now the scenario is that company sent me to client side in bangalore. Before going to bangalore i told them that i got some family problems so i cant go, so the recruiting manager indirectly told me to leave the job. I was little scared and just went there. There after around 10 days i realized that my personal problems are increasing and my family needs me back with them. So i resigned from there and gave them notcie period of 15 days in lieu of 15 days salary and also told as the work has not yet started in client side , so kindly call me back now. But they didnt accept my resignation. I repeatedly called them and mailed them that i wont be able to stay after given date in my resignation letter but they over heard it and i came back after fulfilling mynotice period of 15 days and also mailed them that it's my last day today for the company. But now when i am asking about my relieving letter, they say that you have absconded from the company and they have marked the same and wont issue the relieving as resignation wasnt accpeted.

I have mailed them infinite times and also talked on phone but they are not ready to give. Now in future when i will be searching for the job, i will be needing them.

Also, the recruiting manager (who is now into HR), says to my ex-colleagues that he will destroy my career and teach me a lesson and if any verification comes to him, he will say very negative and will say that i never worked here.

Now please guide me as to what to do and what not. They are asking me to courier them the I card of the company but wont issue the relieving.
I dont know how can they make me work focefully when i dont want to.
The HR Head is very reluctant and creating all this mess. She is behaving very kiddish and says that we didnt accept you letter so we wont give you relieving . In the employment letter it's not written anywhere that they wont issue the relieving letter.

Please suggest me what to do.

thanks for your reply.below are the details you require
according to employment letter:
1. in the event of you being on transfer or depbutation at the time notice is served, you agree to return to the head office of the company and then work out the notice period or pay the amount due in lieu of such notice period.
2. Company reserves the right to seek the extended notice period from you if such need arises. Employee may pay in lieu of notcie period if and only if agreed to be the company.
3. No leave can be availed in notice period.
and i gave resignations on 2nd may and was there till 16th may 08. Also i asked them that i should come back to noida but they clearly told me not to come and not to tell client about your resignation.

Dont` worry be relaxed!
Send one Registered AD to your company giving full details abour your case. Attached your Appointment letter & Resignation xerox copy.
Finally write line that you are not interested to work in the company because family medical reason. Ask them to settle your account & give clearance with experience letter.
Once you have received the acknowledgement. Be cool & try another job... When you are selected, please inform clearly about the matter in advance before they make your reference check.

I had a talk with HR, she says she will give the relieving in 2 months but will put in the content that i have broken the company laws (which i didnt, it was only that i gave 15 days notice period and other 15 days salary. the actual notcie period is 1 month). and also she is getting very rude . i told what have i done , that you will be writing this content in it. she just said, you didnt give us time for replacement..
now what should i do? or should i wait for the letter?

I am 38 year old, i stay in bangalore,i was working for a MNC in chennai, i took sabbatical leaves for about 1 and half year from 2013 dec onwards on the medical grounds of my parents, i resigned from the same stage(sabbatical leaves) on august 2015 as it was not possible for me to goback leaving my sick parents in bangalore. Hr accepted my resignation and assured through the mail that i am allredy released, but she said it will take a month time to issue relieving letter and experience letter after getting a clearance from all the department,so i waited after 3 months hr came back by saying i need to pay 20k bonus recovery amount,for i which i was ready to pay, but they were not ready to give details of mode of payment, i have been asking them since one and half year, now they are saying that i need to pay 60k notice period recovery amount,

Kindly let me know whether i need to pay this notice period amount as i was on sabbatical leaves, even after this since its almost 2 years that i am not getting my relieving credentials kindly suggest me best way to approach for it?legal actions?whether its works? How much time will it take?

They are playing with me since 2 years pls suggest.
