I'm working as HR Executive in an Indian company.
The employees who have been in the company for 6 months or more are required to given minimum one month of notice in case they don't wish to continue their services with the company. This clause is clearly stated in the Appointment Letter given to all employees.
However, the employees tend to leave as soon as the salary is transferred to their accounts.
Please tell me if the company can take any action against such employees.

If they are not interested in collecting their full & Final settlement you cannot do anything..or what u can do is maximum hold their Experience certificate and relieving letter and deduct from their F&F.
Best of luck in not gettting such employees

the best thing to do it that inform their new company where they have joint that this person has not given the prior notice and not cleared the dues this is best thing to do

Dear Anika,as per my opinion, an HR person can do the following steps:1) If a new candidate joins your company, he / she undergo's a probation period for 6 month. if that new joinee leaves the company during the probation period, then they have to submit the resignation letter as well as the payment for the six months probation period.2) if the candidate is in the training period for the period of 1 year and that candidate leaves the organisation before the completion of 1 year, then the candidate has to pay the amount of 1 year to the comapny(as per the claiuse mentioned in the appointment letter)RegardsAnkit09869851356

Greetings. Good question. These type of sufferings are ofen facing by Most of the Managements.
As said by ankit Chaturvedi, the new person has to be put on Induction Training atleast for 2 months. Generally these two month period will mould the individual according to the organisational culture. If he suits to the particular environment by himself, it's ok otherwise, let him go. There won't be much loss to the organisation unless we have to search another suitable person.
Here, on the other side, we have to analyse what is the wrong in the Company which make him dislike the company. This is more important.
For this I suggest, there should be an appraisal need to be collected from senior employees of the organisation about the General Opinion of the organisation. This will help in improving the organisational culture.

Can any one tell me that what all legal actions can be taken against a employee who leaves the company without submitting the resignation letter and also he doesn't follow the notice period criteria.
