What is the legal position regarding deduction of PF on Minimum Wages declared by various State Governments ?
Whether the employer is right to bifurcate the Minimum Wages and deduct the PF only on basic ?
Please give the case laws, if any, available in this regard.

Dear Friends,
I came to know that PF COMMISSION at Faridabad(Haryana) had passed an order that the PF will be deducted on minimum wages.
(This order has been passed in a case where Honourable Court has asked to the Organisation to pay the PF from back date with interest and damages)
If sombody has copy of order of the Honourable Court and order from PFC please post it.

Dear Friend Minimum wage has been defined as Basic + DA in the act itself so you can’t biforcate further... Vasanth

The P.F. Contributions to be deducted on Basic+DA/VDA.
The PF authorities will see the Basic and DA/VDA of the Salary and they will insist that both together should be minimum 50% of the total Gross Salary.
Where as the Labour authorities will see the coverage of Minimum wages on employees. The minimum wages should not be less than the declared by the Labour authorities. The minimum wages are vary from Industry to Industry.
