Need to know on overtime policy. There are lot of calculation I have seen in few posts, little confused. :?
1. Is the overtime hrs fixed if yes then how many are they?
2. Should the overtime pay be mentioned in the payslip or its optional?
3. If the employee is on leave say for 2 days but worked overtime the rest days and still cannot makeup to the total hrs, will he be payed?
Mine is a US based co. and work 5 days a week for 8-1/2 hrs.
Please suggest me on the calculation part.

as per rule 48hrs hs to be worked in a week if not overtime may extend to 60 hrs beyond that it should not go we have to pay double the wage for the overtime

When a worker works in a factory for more than 9hrs in a day or for more than 48 hrs in a week he shall in respect of overtime work be entitled to wages at the rate of twice his ordinary rate of wages.- ref Factories Act ,sec 59(1) Extra Wages for overtime
For calculating Overtime wages all components Basic+DA+ all other allowances excluding bonus and contributions paid (PF,ESI etc..) should be taken in to account – ref Factories Act, sec 59(2)
Overtime wages should be mentioned In the pay slip(see rule 26(2) of factories act, Minimum wages act 1948) . Also can refer Form XI (wage slip)
Sec: 64(4) – Limitation on Overtime hours
(i) The total number of work in a day shall not exceed ten.
(iii) The total number of hours of work in a week, including overtime shall not exceed sixty. – Means an worker can have 2hrs (8hrs+2hrs) overtime daily, considering a week.
(iv) The total number of hours of overtime shall not exceed fifty for any one quarter (Quarter means a period of three consecutive months beginning on the 1st of January, the 1st of july or the 1st of October.)

In my opinion section 64 imposes conditions for State Government while making Factory Rules for taking overtime from the workers. These are points which are to be kept in view while framing Rules for limit of work & OT. Section 64 (4) does not allows us to take O T. In my opinion we are required to go through the applicable State Factory Rules for taking OT work from workers.

hi, in Maharahstra we give 12 hours duty to workers from 7.00 A.M to 19.00 P.M (normal working 7.00 to 15.30 including half hour lunch ) and pay O.T after normal working i.e., 3.50 hours @ double, and in this case we take production of 10000 pieces in normal hours and 5000 pieces in O.T hours which is half of normal hours is it right.
if workers from night shift called for 12 hours duty from 19.00 P.M to 07.00 A.M including dinner (normal working 23.00P.M to 07.00A.M ) and pay O.T for, 3.50 hours @ double, and in this case we take production of 10000 pieces in normal hours and 5000 pieces in O.T hours which is half of normal hours is it right.
