The trade unions of workers have been associated with the film industry for many years. I want to ask, sir, a representative of the trade union association, if the company terminates workers on unnecessary grounds without checking facts. If the workers ask or object, they are told to go to court and file a case. This has happened before, and it is happening again. If a worker approaches the court for illegal termination, the union will not appear, and this will continue until the ex-parte order is given. However, this ex-parte order will also take nearly 1 1/2 years, during which all the pain and pressure will be handled by the worker. I want to ask a respected group for some remedies or if it can be stopped so that workers can be protected from this type of harassment.

It sounds like you are deeply concerned about the unfair treatment of workers in the film industry and the lack of strong intervention from trade unions when workers are terminated on unjust grounds. Here are some points you may consider while addressing the representative of the trade union association:

Key Questions to Ask the Trade Union Representative:
Unions Role in Worker Protection
What is the trade union's official stance on wrongful termination cases?
Why does the union not intervene when workers are unfairly dismissed?
How does the union plan to ensure that workers do not have to suffer prolonged legal battles alone?

Support During Legal Proceedings
Can the trade union provide legal assistance or financial aid to workers who challenge wrongful termination in court?
Why does the union not participate in the case to prevent an ex-parte order, which takes nearly 1.5 years?
Is there any mechanism where the union can act as a mediator before the case reaches the court?

Immediate Remedies and Preventive Measures
Can the trade union negotiate with production houses to introduce stricter regulations against arbitrary termination?
Is there any possibility of setting up an industry-level grievance committee that can take immediate action before a case is dragged to court?
Can the union advocate for a law or policy change that speeds up the resolution of such cases?

Accountability and Action Plan
What steps has the union taken to prevent recurrence of such issues?
How can the workers ensure that their voices are heard without fear of retaliation?
What reforms does the trade union propose to prevent future exploitation of workers?

Possible Remedies & Suggestions for the Union to Implement:
Fast-Track Arbitration: Unions can push for a dedicated arbitration panel to resolve disputes faster rather than forcing workers to go through prolonged legal processes.
Legal Representation: The union should have a legal team ready to assist wrongfully terminated workers.
Blacklisting Unfair Employers: The union can create a database of companies with a history of wrongful terminations and warn workers about such employers.
Public Pressure & Awareness: If legal means are slow, public campaigns, media coverage, and social media pressure can help bring attention to unjust practices.
Worker Protection Fund: A financial aid system to support workers while they fight their case in court.

In respect of workers engaged in film (movie) production, who is the employer against whom the worker is fighting legally? Who is the company or establishment? It is true that motion picture making comes under the industry as it involves the cooperation of people and financial resources. It is also true that the workers engaged in movie production can form a union. However, in reality, when a dispute arises, there should be an employer against whom demands are made. In movie production, a worker may be hired by different producers, correct?

(Fact Checked)-Your point is valid. In film production, workers may deal with various employers. This complexity can sometimes make it challenging to identify the responsible party in a dispute. However, every worker has the right to a fair and lawful treatment regardless of the industry. (1 Acknowledge point)

  • Dear friend,

The truth is very hard and harsh because to get justice against the termination is similar to a daydream. Our judiciary, in the present day, takes long years to decide the case, and the end result is to come from the apex court of the country; therefore, justice is far off. Without the help and cooperation from the trade union, the employee shall stand fixed in a case. The person with sound financial health must fight the case. It will be wise to give up the idea of contesting the case for a long period.

(Fact Check Failed/Partial)-While it's true legal battles can take time, it's important not to lose hope. Labor laws and courts are designed to protect workers' rights. Persistence can lead to justice.
