The duties of the presenting officer is well known in every disciplinary cases. But, it's true that the presenting officer cannot take suo-moto decisions unless and other wise they are approved by the disciplinary authority and it is reiterated in several manuals and hand books developed by several departments. For instance MHRD, Hyderabad, Hand book on disciplinary Proceedings designed by the A.P.Vigilance Commission, Hand book for inquiry authorities and disciplinary authorities developed by DOPT, GOI and, Regional Training Center, Sardar Patel of Public Administration, Ahmedabad and several others reiterate the same. But, it was not emphasized anywhere in A.P. CCA Rules, 1991 or Central CCA Rules, 1965. Therefore, under which notification either from Central or A.P. State it can be noted that "every action of the presenting officer in disciplinary matters should be with the approval of the disciplinary authority". Or any decisions of the high courts of the Apex court of India are available may please be furnished. .
