Our company has fewer than ten employees, and we are not registered / eligible for PF registration. We have to appoint a 20 lacs per year package person, and he is asking for a PF deduction in the salary breakdown. Please suggest a salary breakdown, and can we show a PF deduction in the salary breakdown?

Since you are not covered by EPF and MP Act, you cannot give coverage to a particular employee alone. It is necessary that the establishment should be covered first and then only we can take a call how to enroll, who should be enrolled, on which salary should we deduct and contribute PF etc. Therefore, you may just say that we are not covered by EPF Act and for the time being we are unable to cover you under EPF. He may be an existing member, and for an existing member of PF the salary is not an issue, and whatever be the salary he should be covered. But if the establishment is not covered by PF there is no way, but he will have to wait till the establishment will have 20 employees and thereby becomes a covered establishment.
