Hi everyone !!!!!!!!!! I want to understand legel aplicablity of an employee who is exempted in esic act ..in which rate of compantation will be paid to him if employment disablity or death occers

It will depend upon the rate as per the Employees Compensation Act. If yours is a factory, then it will have a direct application to all employees, right from the MD to the casual worker, but if yours is a shop or commercial establishment, then the compensation is payable only if the decease employee comes under the schedule of the Act. Please refer the Employees Compensation Act for details. The compensation will depend upon the wages and the age factor. Maximum wage for death case or permanent total disablement is Rs 15000. The attachment shows thee compensation factor corresponding to the age of the employee.
