Hi team members,

I recently joined a company. There are 11 months of ESI not filed, and also, new employees have not been added in previous months. What is the procedure to file returns, and what about the new IPs?

Not registering the employees on their dates of entry and non-payment of contributions are serious non-compliances.

When you register an employee after ten days of their joining, the system will automatically generate a show-cause notice, and you have to explain the reason for the delay in registration. You can register them now, but for all benefits, the date of registration would be treated as the date of joining.

To pay ESI retrospectively, you will have to provide the actual date after replying to the show-cause notice. In the case of those who were registered but contributions were not paid, you can pay now, but with interest and penal charges.
