Dear Seniors, Can anyone please help me with the casual leave provisions applicable to any establishment as per Maharashtra shops and establishment act.
1) Is it good to follow leave credit annual / monthly basis?
2) If an employee onboards post 2nd week of any month, is leave crediting necessary for that month?

In Maharashtra the employees in the shops and commercial establishments are required to get 8 casual leaves in every year. It should be credited on a quarterly basis. The Act is silent about advance credit of leave. But in the absence of any specific direction, it shall be presumed that CL shall be credited in the beginning of each quarter. Since one quarter accounts for two days' leave, you can decide about granting it proportionately. In order to make the leave crediting process common, it is desirable to take the first of every January, April, July and October as cut of dates.

Yes as said by Madhu there Act is silent on advance As per Maharashtra S&CE Act 8 Leaves are CL cum SL. Better consider as prorata for the whole year
