Is it mandatory for sick leave to be accrued?
Can the employees be credited with total number of sick leaves at the beginning of the calendar year with prorated calculation? In case the employee resigns mid way and has availed excess leave then the excess to be adjusted with F&F. eg an organization has 12 sick leaves in a year, all the 12 leaves are credited to the bucket at the beginning of the year.Pro rated calculation is 1 every month. Now if the person leaves in April but has availed 7 leaves, then excess 3 to be adjusted with f&f

Sick leaves, like other leaves, is regulated either by the company policy in this regard or by the law in force. In INDIA, only establishments other than factories, mines or plantations have sick leaves as a matter of employee right. That also depends on the state notification because the Act to regulate the service conditions of employees in Shops and Commercial establishments is a state Act and as such different states in India shall have different provisions in this regard. Therefore, if your establishment is a shop or commercial establishment, you have to refer to your state Shops and Commercial Establishments Act to decide whether your employees are entitled to sick leave or not.

In the case of factories, mines etc, as there is no sick leave as per law, the same will be regulated by means of company policy in this regard.
