Hello everyone... I want to know about the leave benefit (EL, SL, CL) and calculation according to factory act Haryana. And please provide any notification or act about it.

Factories Act is a central Act. So far my knowledge goes, no State in India has made any leave rule deviating the central Act. Please go through the Factories Act, 1948 "leave with wages" chapter and you will find the Annual leave benefit as per Act. There is no such provision of SL & CL under Factories Act. If your organizations has any Certified S.O. or Union agreement where it may be mentioned about provision of SL & CL.

Factory act just states that workers will be given earned leave at 1 day for every 20 days worked (days worked includes weekly offs).

The breakup between the various components is mostly an internal decision, which is fine as long as 18 days of unrestricted holidays.

If your factory comes under Standing Orders act, (more than 50 employees) then you need to see the holidays specified under your model or certified standing orders and structure your holidays accordingly.

Factory Act say about Earned leave as every worker who has worked for a period of 240 days or more during a calendar year or if his services commence after 1st of January ,then for at least two thirds of total number of days in the remaining part of the year, shall be entitled to following leave with wages during the next calendar year
a) Leave of one day for every 20 days of work performed, if he/she is an adult
b) Leave of one days fore very 15 days of work performed if he /she is a child.
Any fraction oof leave of half a day or more shall be deemed as one full leave.
There is no provision for sick leave and CL in the factory Act.
