Hi everyone, Need your suggestions. I received a legal letter from HCL technologies asking me to pay a sum for not serving my notice period. Details below
I worked with HCL from Dec 2016 to Aug 2019. I was moved from a project to a bench in March 2019. No project was assigned to me so HCL HR and bench manager relieved me of the duty immediately. Now I received a legal letter stating that I have not served the notice and asked me to pay my three months basic. What can I do? I am not in India anymore.

In effect it appears or best can be considered as 'retrenchment' and by any stretch of imagination can be considered a resignation. If so, where is the question of serving notice period or recovery of 'notice pay' in lieu thereof. Looks strange and arbitrary. On the contrary you are entitled for compensation, notice pay and other full & final settlement.

Pl reply to them stating the facts as above and refuting the demand for payment of notice period. Support it with documents. You can ask for the payment of notice period. You need not reply to the advocate but send it to the HCL Technologies.

The terms of your employment and the communications sent by HCL Tech to you are to be perused before giving opinion S.K. Mittal 9319956443
