Hi, I was working with a big and renowned corporate house in delhi. In the first month of joining the company I faced bullying, hostility, humiliation and comments on personal life by boss (president level) and a threat to terminate if i don't resign immediately from the company (all this happened in the very first month while I was on probation). I went to HR for help and requested them to change my line manager. HR took the entire case to grievance committee (all video recordings for my testament was done) which went on for a few months (approx 4-5 months) and they extended my probation period (which was earlier 3 months) by another 6 months (for not been able to see my work). During pandemic, I get an email from the committee they took a decision that change of dept should be given to me as change of line manager is not possible. HR intentionally tried to put me in administrative role (without any matching skill set) so that I resign on my own. they said no matching job is there in the system due to covid and business is low. I gave my consent for the new role considering pandemic, while making a request to change my dept later on when business becomes normal. To which HR called me to office to have a discussion around new role (during this pandemic) and unlawfully confined me into meeting room. they snatched my fone and laptop away. they told me to resign else they will terminate me since it was a last day of my probation period. I was held like a hostage with no washroom and food permission. they was no other staff in the office except the HR team. They all ganged up on me, Intimidated me and mentally tortured me to resign.

They threatened me to spoil my reference check for future assignments. In lieu they gave me a compensation of a one-month extra salary and settled my F&F. It all happened 2 +months ago and due to the way it was handled, I went into shock and anxiety attacks and could take any decision earlier. I am still out of Job and situation is uncertain due to pandemic. I want to ask the experts here:

1. Can I file charges of Mental harassment, Torture, unlawful confinement, Intimidation against the HR team members who were present there?

2. Can I ask for damage caused to my mental health due to mishandling and misbehavior?

3. whats is the way to get a closure here? writing to board of directors or sending a legal notice if a case is possible?

4. Shall I ask for the video recordings/ documents from the HR, which are actual evidence of the harassment case I had put against my line manager?

Advice will be appreciated.

Revenge, retaliation etc are purely negative thoughts and if you indulge into this, will result only wastage of time, effort and money. You can take legal action against anybody, you can send lawyer notice to anybody; but ultimately what will you achieve?

If you take action against HR team who belong to a company of repute, company will pursue the matter. You are only an individual. How long an individual can fight against a company.

ultimate result need not be as favourable as you expect it to be.

Whatever happened is happened. There is no reversal of actions. So live and think only today.

Just sit alone and analyze event by event about the happenings, what went wrong and make corrections.

As you have received final dues, you can just ignore this. Try to get a new job. As you have completed only probation period, and as you expect nothing favourable they can do for you,

you need not mention this employment in your CV, instead you can mention that you remained at home, in view of pandemic covid-19 (which can be a blessing in disguise, in your case)

First of all I am really saddened listening to the trauma and bullying you have went through.

This kind of conduct on part of company is highly condemnable and should be brought to notice of appropriate authority.

1. If you are female and there is any amount of sexually colored/biased remarks/actions/intimidation/advance by your ex-boss was involved during entire episode you can file a complaint under POSH before district nodal officer under POSH (Generally District collector).

2. Else you may prefer to file a police compliant under CPC - for mental harassment and forceful confinement etc.

3. Practical advice is to get your documents i.e. relieving letter, experience letter etc. straight and look forward towards your career, leaving behind the bitter experience.

Dear Members: Thank you for the advice. I understand you guys are suggesting is to not to mull over the past. The trauma has affected me badly and shaken up my confidence too.
I have got my reliving letter already.
Do you suggest to take a copy of my video recordings of Grievance committee from the HR department? Could there be any potential of evidence getting misused by the company?

Don't worry about it, leave it / forget it everything and don't dry to take any video recordings from the committee or HR Team. Once again forget everything, close your eyes and open your eyes with new vision of yours and you may get beautiful future.

As suggested by members go ahead and prepare for better future. Do you think organization will provide you the recording which may be used against them. First of all What is you goal,What you will get if you fight a legal battle with organization.? Is the result will add any extra medal in you life of services. What will earn you if add your energy in other directions for enhancement of your skill and knowledge ?

Hi,
It is better you go for counselling and get yourself treated of the trauma which you unfortunately had to undergo. Make a list of things that you were made to undergo at your ex-employer and the people involved in the whole fiasco. Maybe a day would come when you may be in a position to hit back through social media or whatever means available but with some evidence to back you up. If the whole management is involved then it only shows the type of work culture the company has in place. But for now try to compose yourself and take a break and come afresh in the market.
Though it is easy to give lecture to forget and move forward, there is nothing much you can do without any hard evidence and with our present system it may not be easy to get a judgment in your favour , at least it is not easy. Seniors are advising to forget not because you are a junior or you are not experienced but most of them are learned and have seen some of the instances which may look easy to file a case but never so easy to go through the process, not to forget that you still have to make a living through employment.
So better think about your future, take a break and if possible counselling and start afresh.

The questions which are engaging your mind now, should have been hit when the iron was hot - when you were in the thick of it. By your inaction, then, you allowed situation to ride over you.
