I am an employee of a private Limited Company based in Kolkata, India. The company has a total employee strength of 6 including me. My Monthly Salary is Rs. 50,000 and my take-home after deduction is Rs. 47,892. I have joined this company in February 2020. To date I have received Salary for the months of February and March. The company has paid 50% of the salary of April 2020. Then the Company has paid the full Salary of May in fragments. Now the 50% salary of April is pending, then the full 100% salaries for the months of June and July are pending.

I have persuaded the company several times requesting them to pay the salary, but the Company continues delaying. It has happened with other employees too, but now they have paid all other employees an amount which is 50% of one month, but they have not paid me a single penny. It is also uncertain that when they are going to pay. in the meantime if they terminate my employment also I am afraid that they will not pay the pending amount as they have done with a couple of other employees who have been asked to leave the company and the salary of them is still due. Without this salary, I am unable to continue my livelihood and without this salary amount, I am unable to bear the expenses of any legal case. Can you please advise that what shall I do in this situation.
