Hi,

Please help me to recover the amount from the employee. Our company operates in the service industry, and our client has been debited a large amount due to a mistake made by our employee. We have been deducting a small amount from the employee's monthly salary every month, and it will take up to 5 years to recover the full debited amount through these monthly deductions. If an employee absconds from duty, the company will face financial losses. The company can hold or stop the PF withdrawal process until the recovery amount is received, or any other ideas for recovering it are welcome.

Hi,

PF is a statutory employer and cannot hold it. As an alternative, collect post-dated cheques from the employee with a self-declaration on stamp paper about the purpose. The employee has to honor the cheques, and in case of bounced cheques, a criminal case can be filed against him.

Employer cannot hold the PF of employee and if he does so by not Authorizing employer will be liable for prosecuting if employee file a case with labour commissioner
