Hi,
In our organization there is Notice Period of 2 months, I have got the good opportunity in other organisation with good pay package.
I have intimated my current organisation that iam serving the NP for 1 month & for 1 month you can adjust my pending leaves.
But company is asking there is no provision to adjust the leaves in NP. If not served the 2 months NP then they will put the remark as Abscond. Is this fare?
In Appointment letter there is clause that either party to provide Intimation of NP or salary in lieu of NP.
So as per this iam ready to pay the balance amount to the organzation, but still company is not ready to relive me.
What to do in this case?

If you are not from managerial / supervisory category then you may approach labour officer for the same. But if you from managerial or Supervisory Category then your need to settle the issue by mutual discussion only.

Dear colleague,
Apparently , you have partly fulfilled the condition of your appointment letter. You have given one month's notice but have asked to adjust against leave for balance period of one month. Instead you offer to pay one month's salary in lie of the notice by attaching cheque to your letter and request them to relieve you.
Since your fresh action is in line with the terms of appointment, they may not take proposed actions against you and hopefully your separation will be less troublesome.

Thanks, Upon putting the mail that my next employer is ready to buy out the remaining 1 month NP, Still the company is not ready to relive in time. What to do now in this case?

Dear colleague,
You once again write saying that you have fulfilled the conditions in the appointment letter and you are entitled to be relieved on due date. If no release letter is issued by then , you are free to leave the job and any action contrary to the terms of appointment by the company will be suitably dealt with.
