I was wondering what should I do as my employer is not giving my pending salary for 2 months and my vacation leave settlement. I am going for my vacation tomorrow, still he's telling that he don't have money but we are always having a business and projects. Our salary is always late as well. We received our March salary last May 31st only and only 1 month still 2 months pending. What should I do?

Please submit the application to labor court, and wait for hearing, if the company is lay off condition also the employees will get benifits.

Is the company having timely and adequate cash flow?
Sometime company may be having adequate projects but billing and getting money may be getting delayed.
Are all employees facing the same problem?
Are creditors being paid in time?
One must see whether delay is intentional or due to genuine problems.
Affected employees need to talk to management first about delays and if no result,then go to labour officials of the area with problems.

Ask the employer for the reason for delay, if there is enough project or not ideally employer are liable to pay the salary.

As per the UAE Labour Law, the salary cannot be delayed more than a week in extreme business conditions. But if it is a regular monthly issue then the Company is in violation of the UAE Labour law.
The UAE WPS Act, clearly states that the salary has to credited to the employee on the salary due date.
Some Company Managers or PRO try to intimidate innocent employees against severe action inorder to scare them. However, an employee needs to remember that the Dubai Police and Ministry of Labour works on such cases in the employees benefit if the employee's claims are correct, accurate and with bank records, evidence and paperwork.
