Leave wages if not given by principal employer in Tender also & at the end of the tender its asked to be paid by the contractor.Leave wages if not given by principal employer in Tender also & at the end of the tender its asked to be paid by the contractor. In tender their is no provision of leave or leave wages but its written in tender to follow all the labour laws. Also the contractor is working on the rates provided by them excluding profit. If no were mentioned in the tender for leave wages or leave how can the Principal Employer bound to give leave wages & in what basis. As what i know that the law has to be followed both by Principal employer & contractor. Please help that the contractor should pay or not.

As employer it is your duty to follow all specified labour laws which are applicable to you. Also, if you as a employer is not following the rules then principle employer is liable to pay or follow the labour law which ever is applicable to the employees and employer. Many of the cases where contract labour are included, contractor charge leave amount separately to the principle employer.

Initially any compliance officer will look into the records of Labor Contractor then shall go into the liability of Principal Employer.
As the principal is not willing to pay Leave wages & the rates are not feasible for profit,suggest to discuss with the employer and go for a decision.
