I need the Acts and rules of Tamilnadu under which an employee can be terminated due to long absenteeism (more than 3 months) due to illness. Kindly help me with the exact letter format also to proceed for the same.

Hi there
I am not sure, if all due process has been followed. Ist of all you need to know the grounds on which the person is ill. Next, medically if an employee is not in a position to report, then how does he report to work.
As along as there is communication from employee and supported by necessary medical certificates, then reasonable time has to be given for employee to recoup., alternatively personally HR person visits the person's house and get's 1st hand information. Subsequently, send a mail to his /her present and permanent address giving time and asking to report, once you feel the illness has subsided or not there, the employee is not traceable., by registered post acknowledge due. Build a case, you in general cannot terminate a employee , when he is actually sick, which will not hold good case for the company.
Hope all the above are first followed, before the action from your end is initiated.

If the employee has not reported regarding health issues, he has to put an official email or update the respective HR. If there is no such information passed on than the employer can issue absenteeism letter after 3 days from the LWD. Post which if no response from the employee termination can be done because of no intimation.
