Hi,
One of my employee sent his resignation on 6th Jan and he is supposed to serve 2 months notice period. But he is ready for 1 month and can we hold the entire 2 months salary till full and final settlement . We will release it only after he finishes his 2 months NP
Will this be ok , any legal consequences ?

What is the effective date mentioned in his resignation letter? Whether it is after the one month period he is ready to serve or buy-out as the case be? In any case it is not legally correct on your part to with hold two months salary.
