Hi All, I have joined the new company As a HR Manager so they have one rules that they can swap their weekly off. Here this facility is only for the support team which is working for 24x7 and their weekly off are given on other day of the week not Sunday. So if they want any leave they just go on swaping their weekly off according to their weekly off with leaves so ultimately there are no leaves when they want them, so for this i have to frame the policy .
So please help me for this.

Dear Vidya: If you are in manufacturing activity you will have to follow the provisions of Section 52, 53 of the Factories Act 1948, otherwise the provisions of the Bombay Shop & Establishment Act has to be followed in swiping off the weekly off. Once you clarify the coverage, the details could be explained.

Section 18 of the Bombay Shop & Establishment Act mandates that there shall be one closed day for all establishments. But the weekly off of the staff can be staggered.

Dear Ms. Vidya,
Basically for all these needs there is separate act called Weekly Holiday Act but it is not applicable for Maharashtra state. Secondly yes employee can exchange their weekly offs but as per shops you need to have monthly duty roaster as per defined format which is supposed to be available with the HR department in advance only. If any employee want to change his / her weekly off he should be allowed to exchange max by a day or two. As weekly off supposed to be given in every week thus you should make sure that the employee should work for minimum 4 days within 2 weekly off's which will help you to comply.

As suggested by seniors Mr.KK!HR,Manoj here you need to follow the state acts as well as maintain their attendance register.
Swapping of weekly off can be possible for Support team as it is a Management requirement and you are giving them alternative offs.
If it is Factory/establishment a compensatory off should be given within ten days of working continuously, ensure that and you can ask them to swap their regular weekly off fixed.
