I am working in a company, where the employee strength is 50+. This is a Private Company running by 2 director’s family members.
When I joined in HR department I was replacement for one of my colleague, who was pregnant. Later I receive a PDF Leave policy with company logo, where no maternity leave/paternity leave mention.Later I come to know the employee I was replaced she struggled a lot but she was forced to put resignation for pregnancy.
In India most of the Indian startup company are not following any maternity policy and lady employee are forced to resign.
I already having a gap of my career for my 1st baby where I forced to drop resignation. And after that, this issue will become major for not getting job.
1. Now I want to understand what are the policy or support we startup PVT company employees have that we can oppose on that?
2. Is there any audit going from any department/Govt, that these companies are following leave rules or policies?
Please help to understand what step I should take being a lady and being an employee in HR department.

This leave is covered under Maternity Benefit Act. It is applicable to an organisation once they have engaged 10 employees. Under this act a women employee get 8 weeks of leave before the delivery and 18 weeks of leave after the delivery.
My suggestion is to raise a complaint to Cheif Labour Commissioner in your region. Definitely the authorities can take necessary action against the company.
