Dear Senior,
Please advice , if employee who is working as designation –Senior Supervisor from last 18years & two times refused his promotion letter in previous years for next Executive level designation then again can be promote Senior Supervisor level(Emp.salary 35000) level to next Executive level based on promotion policy as per certified standing and if concerned employee the refused the promotion letter & doesn’t want Executive level designation-Junior Executive from current designation –Senior Supervisor then in this situation ,management could take any action against him.
Promotion policy as per standing order:
No workman shall be entitled to automatic promotions which are at the sole discretion of the Management. depending upon vacancies, requirement and over all suitability etc. to the job.
Employee’s promotion to a higher grade/skill is the executive right and function of the Management. While promoting an employee his merits and seniority will be considered as main criteria. In deciding this factor, the employee’s/Workman’s qualification efficiency and attendance, past service records shall be taken in to consideration.
Requested to please review & advice further in this matter.

Dear Vishal,
There must be a reason to why he is declining the promotion. You need to find that out. Similar to this in many companies people refuse the promotion just to stay away from responsibility & accountability. Also, Some allowances like encashment for extra work or OT is allowed till certain grades this could also be the reason to refuse promotion, transfer in location/department is one more reason for refusal. In such case if employees are refusing promotion and reached the threshold of there pay grade. Some companies also re-designate the employees. but, please take advice of seniors in this. I request seniors to put light on the subject.

You have given details of the situation related one Sr Supervisor. You wanted to know what "action" can be taken against the supervisor for refusal for the promotion. Well gentleman, why you would like to see anything and everything from the discipline/indiscipline point of view? Going further have you defined "refusal for promotion" as misconduct in your standing orders?
In your post, you have not written why employee has refused the promotion? What are his reservations? What is that holding him back? Why he thinks that he is fit to be at lower level but not at higher level? Have you tried to understand why he wants status quo?
Possibly that employee's mind is conditioned to execute the duties of his current designation. While others hate monotony or repetitiveness in their work, he could be enjoying it. Secondly, he could be perceiving that the Executive level job demands getting work done from others. He could be hating to do that. He could be thinking that let us obey the orders and enjoy a peaceful life. The second reason could be that he might be required to work well beyond specified working hours. He might not be ready for that. The third reason could be requirement to learn new skills. Possibly his self-contentment could be prohibiting to take assignments of higher order.
The incident could be reflection of lack of career-planning initiatives in the company. Ideally HR is expected to help each employee is preparing career plan. Each employee needs to be groomed or developed to hold the senior positions. HR is expected to infuse career-consciousness amongst juniors. Unfortunately, HR is so ensconced in their own work that hardly they get time to plan someone else's career!
Once again, I can only say that we need to understand the employee well. Therefore, convene meeting with senior person in the technical department and understand inhibitions. However, please be friendly and not pushy in the meeting!

If somebody not interested in promotion then why you are interested to promote him " designation wise" rather increase his work / responsibility in actual. Failure to do so ask employee to go home in Legal way.

Actually ,we have two employee working as Senior Supervisor from last 18years in same designation & they both getting salary >35000/month & they also performing role as union leader of un- registered union in our company from last 18years.They said that you can't force for promotion to next executive level designation.they assume that we are working as supervisor which comes under workmen category

Dear seniors,
Also ,informed you that they both had done appraisal of junior employee,leave ,gate pass from last so many years & in every situation -They both creates employee mob against management & provoking other employee against management in small -small issues.
Even after , management has increased his higher salary every year at the time of yearly increment so that they could be silent but they both every time creates problems against management to get his good increment.
they said if we jumped in to management level designation then they will loss union shelter. Actually ,they are playing with management from last so many years but as per current situation other employee are not supporting him on same issue.

I have two queries on the subject
1. Are the Supervisor / Senior Supervisor coming under "workmen" in your company?
2. Do these Supervisors get overtime or any other benefit which is denied to Executive category?
If the refusal is because of getting out of Union fold thereby losing the benefits which he enjoys otherwise, and the person does not see much possibility of rising further, such employee can refuse promotion. You have to be open to them on this otherwise they will suspect your intention to promote.

Reply of quires:
1-They both are not comes under Workmen category.
2-they don't do overtime..
They assume that if we jumped in to management level designation then they will loss union shelter.
They said that management can’t give promotion by force & also, said that nobody can promote us during my whole employment at company.

You need to show them that neither they are under union shelter nor they comes under worker category. They are staff and management can re designate them as executives. You just have to pass the order of re designation or can transfer them to some other department to break them. If they resist conduct the inquiry suspend them pending inquiry and if found guilty of charges terminate them. get over with it don't let them bully the management. please consult your legal representative while doing this. Don't leave loopholes as the case can go to court. Conduct the inquiry on principles of natural justice. Keep evidence and records. Also if they comes under staff category you might have issued them appointment letter in which general clauses of transfer or promotion etc are mentioned. you can use those documents. This is what i would have done in general scenario. Experts may have different opinion in such case they can put the light on the subject.
