This query regarding leave en-cashment policy
Mr X resigned from the post and paid sum of Rs 60K towards short fall of notice amount , Short fall amount was calculated on Gross
At the time of full and final settlement Mr X's leave en- cashment was calculated based on Basis pay
Can company take Two Stands --- Notice pay is on Gross and Leave En-cashment on Basics?

Dear sir,
It all depends on company's service rules, that varies from company to company.According to me, said practice is alright, justified and fair. If gentleman would have served full notice period , he would have got all the components as gross salary. And in reverse which he is to pay back as notice pay is gross salary because he decides not to serve notice period.Like wise , purpose of leave is to utilize all leaves not to keep it for encashment.However, we in India do not go for family tours/ holidays much. As company also takes works when employees are avaiilable maximum,therefore company considers encashment of unavailed balance of leave on basic salary only in their Leave matters as conditions.You might have observed that leave encashment is a welfare policy not being made applicable in new set up, as they want from their employees to make leave plan also and avail them.
