Greetings to all! One of our employees was fired from the organisation because of misconduct in Jun-16. Next month his name was de-registered from EPFO & ESIC records. On his further requests and due to certain reasons the administration agreed to take him back in job on the same position with all the earlier conditions. He is likely to re-join the job from Oct-16.
Now, I want to know that:
i) Is there any time period which explains that an ex-employee is prohibited to re-join the same organisation for the certain months/period?
ii) What about his UAN.. i.e.. would he be allotted a new member id for PF purposes?
Please explain and suggest what happens in such a circumstance.

Previous UAN would be seeded with new EPF number ESIC card would also remain same

Same ESIC number be used with current date of joining and issue new PF number and later linked with earliar alloted UAN number.

do not try this, it will make a SERVICE BREAK , as the date of exit is already submitted, and it will make a lot of hassle to add old fund to new fund contribution,
when you will allot him a new number and later link with old UAN, it will ask for bank account and aadhar /pan details, if both are verified earlier, then transfer will get auto clicked,
if kyc is not updated, then you can do it right now, before linking his UAN to new alloted epf number

If the employee has not withdrawn the PF accumulations, it is advisable to allot him the same PF number and UAN and make the future contributions to the same account. The two months period during which he was not in service will be treated as "non contributory period".
In the case of ESI also, use the same IP registration number and continue contributing. This will enable him to get the benefits due to him against his previous contribution period.

I have been very practical to such issues, data of previous employment term is not digital, but manually submitted, so there are chances of error, viz name spelling mistake, relation name, etc.
also the person who is dealing the EPF, can assure to remember the BROKEN service record while making the from 10D enclosures?
once a new number is alloted with correct data as per aadhar and pan number and bank account is seeded. in previous UAN, when the employer confirms his old uan, and submit the already seeded bank details and PAN or aadhar data, form 13 get auto clicked, and it get transfer to new account automatic. so the spelling mistakes and other errors are omitted automatic.
however if the person who is dealing with day to day EPF work, can keep notes for broken period records and can be able to make available at the time of filing their claim, he can do so. but digital record keeping is always preferred over manual record keeping, thats why the transfer is preferred
