Hello Sir / Madam,
I have not received bonus for the last year from my employer which is termed as Incentive in the employer records.
Reason given to me was that once employee resigns, is not eligible for for the bonus of last year. (2015).
Could you please advise if there is any law under to counter this act.
Regards,
Yogesh

Dear Yogesh,
Please clarify the following:
1. When did you join the company?
2. When did you leave the company?
3. What type of bonus it is, statutory bonus, performance etc?
4. What is the eligibility critera? Has it been mentioned in your appointment letter or you have been issued separate letter?
Thanks,
Dinesh Divekar

Dear Yogesh,
The Statutory Bonus is payable to employees subject to minimum 30 days working in a financial year and drawing salary within the ceiling limits, whether he has resigned or still in service does not matter.

Dear Yogesh
" I have not received bonus for the last year from my employer which is termed as Incentive in the employer records. "
Since the advice seeker has already confirmed that The "Unpaid amount" in terms of "incentive" hence is not Bonus under the provisions of Bonus Act. Therefore can not claim from from employer as per Bonus Norms.
Further the employee is engaged as per appointment terms and conditions and the each part of CTC are payable at end of cession of employments, he can seek remedy under Civil Suit.

Dear Yogesh,
your query is not clear. Whether you are getting Bonus as per the provisos of Payment of Bonus Act, then you ar obviously eligible to receive the bonus from your employer till the date of your leaving the service whatever may be the financial years. If your employer is paying as incentives then matter to be dealt amicably. Unless you clarify it will be improper to give our opinion.
