My suggestion is to continue by getting transfer of the previous employers pf contribution also otherwise you will loose a good amount of accumulation as well continued service.

My Ex Employer says that, It is illegal to withdraw PF except for the below conditions.
Now, when I check with them they say, we can withdraw PF in below cases.
1) Not working in any organization in the near future.
2) Working in an organization where the PF Act is not applicable.
3) Going abroad to work once resigned.

Apart from what your organisation has said, there is also a provision for loan or partial withdrawal of PF amount under certain conditions. You will need to check on the website and see if you fall under any of the conditions specified.

If you file withdrawal, their is an undertaking that you are not working in any establishment in which EPF is applicable since last 60 days. As such you are fling a wrong information which is illegal. Moreover, when your UAN is active in new location, your withdrawal will be rejected.

Mr. PK Sharma has rightly said since you have already given your existing UAN to the new employer the said UAN is active and the contribution is made on the said UAN hence it is not legal to withdraw PF now. You would have withdrawn the PF Amount after 60 days and in your new company you would have applied for new membership/UAN.
