Hi All,
Kindly let me know if an organization which is once registered under ESIC, but now all of its employees Basic Pay is more than 15000 per month, can it withdraw its registration under ESIC?
Also note that the current strenght of employees is also less than 20.

1. Dear member, under the circumstances as mentioned by you, there is no provision of uncoverage of your establishment/factory under ESI Act, 1948. ESI Code Number can be treated as closed under situation of permanent closure of an establishment. Under the circumstances, you/your establishment can simply either send a NIL return to ESIC concerned office, or can inform the said department (SSO, Branch Manager as well as Regional Director) through registered post that at present your establishment has no coverable employee and as and when you will employ persons under coverable limit, necessary compliance will be made/resumed in respect of said employee.
2. However, please also ensure that you are not engaging any casual, temporary and on contract etc. persons upto and including coverable limit of wages since such persons are also employees under said Act.
