Dear friend
You should have taken some effort in giving more information on the matter.
You could have let us known your own views and the reason behind it.
However, it seems you want to delegate all this tasks to the members, and unburden yourself.
Well a brief reply to your brief query :
The solution is : Always follow Rule No. 2.
Warm regards.

In continuation of what Raj Kumar has stated, I am compelled to add that engaging a ( car?) driver on retainership is only a fanciful idea of a person who re-invents the meaning of retainership for the purpose of exploitation of labour. If I were correct, the terms " retainer" and " retainership" are mentioned in no employment related Law. The dictionary meaning of " retainership" is - "( of contracts or services etc.,) having the property of retaining/ retainment". As I am aware of, retainership is covered by the ambit of Service Tax and would be covered by the definition of yet another term nowhere used in any Labour Law i.e., " Management Consultant". Therefore, I am giving the extract of Section 65(37) of the Finance Act,1994 which defines:

" Management Consultant" means any person who is engaged in providing any service, either directly or indirectly, in connection with the management of any organization in any manner and includes any person who renders any advice, consultancy or technical assistance relating to conceptualizing, devising, development, modification, rectification or upgradation of any working system of any organization".

Think for yourself, where a car driver could be fixed in this on retainer basis.

I only echo the views of the learned member Raj Kumar Hansdah.Without knowing your specific views or apprehensions behind not going for retainership of a driver and how you want to employ a driver, it is not possible to reply your query and the learned Senior Mr. Umakantan has adequately explained the meaning of 'retainership' to know whether, by retainership, you mean the same or you meant it differently.

Dear Mr. Umakanthan and Mr. saikumar
Your responses have given such a depth and dimension to this query which initially sounded utterly mundane.
Thanks for enhancing our knowledge on the issue of "retainership" and "who can be a retainer ?"
Warm regards.
