To begin with A Very Good Morning to you. I am having a problem regarding Esic Exemption. According to Esic if an employee getting more than 15000 gross wages so he/she will not be eligible for Esic. So, now my question is that if an employee get gross wage more than 150000 (Wage + O.T) in two or three months in half yearly contribution period (apr to sep, oct to mar) so after that in future he/she will be eligible for Esic in next month or next contribution period. Your reply would be greatly appreciated.

If during a contribution period,excluding OTwages if an employees gross wages is above Rs15000/pm he can be exempted from the beginning of next CP.

I do agree with Mr. Varghese mathew view.
For eligible condition the standard wages earned by the employee should be considered. The fluctuation due to variation in salary due to Overtime and other payments which is not constant, will not be considered for deciding the coverage under ESI.
