Please suggest. We are having few Contractual employees in our organization. Before my joining Hr was not fully functional i.e Manager Accounts used to take care of Hr functions. Because of this employees whose contract have expired year back have not been given any contract letters but they are still working for us. My question is

1. Employees are asking for contract letter for the span they have already worked. Can we provide back date contract letters?

2. In our contract letters intial notice period is 15 days who have not completed 6 months in the organization & one month for those who have completed one year. In case we renew the contract for the employee who has already completed 6 months or one year in the organization, what should be the notice period. 15 days or 1 year.

I wanted to add here after completion of contract the leaves left in person's account gets nill.

3. In case employee leave after completion of contract, and does not have of fresh contract letter with them, can we ask for notice period?

1. a back dated letter wud not be advisable, but a letter that says the contract commences from such an such a date wud be more suitable
2.once a contract is enewed, the notice period will depend on whether u have changed the terms and conditions or jst stated that they will remain the same. always the other party has the choice of accepting or rejecting your offer.
3. once the contract period finishes, the contractor is not bound by any law to continue work unless his contract is renewed, hence the notice period bears no significance

As advised by Vidya,Back dated letters are not advisable.
Secondly once the contract is renewed you can change the notice period if required as its a new contract in the first place.Accepting it or rejecting is in their hands.

dear
can u pls tell whether your standing orders allows to have such type of contract labour.have your contractor taken licence to supply u contract labour,if not it is eye wash aqnd they are your employee.
i feel it is not contract labour it is fixed term appointment,which delhi govt does not allow so in this condition also they are your perment employee and they are eligible
all facility of permanent employee.

there are two types of employement
fixed term
indefinite
mgmt shouldnt mix and match provisions to display compliance to labour laws
eg lets take a 3 month contractual role. if 1 person occupies this role for 4 quarters then this amounts to a permanent role
