I would like to bring in your kind notice that I, Vijay Kumar Tiwari, S/o Shri Hriday Narayan Tiwari worked at Enoch Venture Pvt. Ltd., A-75, 3rd Floor, Sector-5, Noida-201301. One month had already gone but till date I have not received my salary.
In this regards I had a lot of discussion with HR Spoke Ms. Shiwani in HR department and my ex team leader Mr. Ram. But I am not getting any satisfactory answer from them. In fact they are directly denying helping me.
I would also like to intimate here that before living the organization I had already given them prior verbal information regarding my resignation. I also tried to give my written resignation which they denied to accept. Now they are saying that they have shown me in their records as absconding which is not at all acceptable for me.
I request you to kindly intervene in this matter and help me to get my pending salary for Oct’14. I will be really thankful to you.

Hi vijay,
Please read the employment agreement which would give you details about the mode of resignig, resignation in writing on mail or hard copy is accepted.
Incase you resigned via mail and you have that mail then thats a proof that you resigned otherwise itwill be treated as aabsconding, also pls check if any warning letter was sent to you post you left company because as a process after 3 days if absenteeism company has to issue a warning letter stating you to return to service.

First of all the forum does not know whether you were a confirmed employee or a probationer, what was your termination clause, please define so as to give appropriate view. Secondly resignation cannot be on verbal base, it should be always in writing and moreover it is not just an intimation it should be accepted. Lastly with reference to the available information, please speak to the concerned Labor Officer of your area who can guide you further.
