i want to know the process if employee unknowing send the some data from his company email to his personal email id
so can hr will not give the relieving latter to the employee???
please reply me as soon as possible

Also, it would be easier for seniors to respond, if you give some more details.
1. Why the question of relieving letter? Has the employee resigned? OR do you wish to fire the employee?
2. Employee can send mail from company ID to personal ID. Important point is if the data was valuable / proprietory information of company?
3. Do you have any IT policies restricting this type of transfer of data? Do you have any HR policies in regards to support of this termination?
4. Have there been any communication with employee about the matter?

1. Yes, employee has resigned. OR should fire the employee?
2. Employee can send mail from company ID to personal ID. Important point is if the data was valuable Yes it was his own data collected by him only by cold calling in market during on job / no. proprietary information of company?
3. May be any IT policies restricting this type of transfer of data, not confirm is their any rule like this for this issue employee will not get relieving latter,

This depends on the organization IT policy in the employment handbook. But under normal circumstances, organization's confidential information shouldnot be allowed to be transferred or shared.
Also, the employee should be served a warning letter for using the keyword "Unknowingly".

Key board cannot be used unknowingly.
The company should look into the matter.
Who reported the breach,the employee himself or was it found by IT checks/audit?
Employee will have a tough time convincing the company about unknowingly using keyboards.
