I need your urgent help regarding the information.
I am working in FMCG company in Maharashtra. Today one Employment Exchange officer came for inspection. He mentioned that as per the Maharashtra government ruling we there is a rule of 80:20 i.e 80% Maharashtra and 20 % outsiders for hiring in any company which I am not aware of.
And also he said that Personnel/HR Manager should be from Maharashtra who can speak Marathi.
Seniors I am not aware about these laws need your help, Is there any law a s such?
Please help.
Also please hep me with the link where I can thoroughly go through the Employment Exchange Act.

To my knowledge, there is no law in Maharashtra which says that you should engage 80 % local persons in employment. There is no law in Maharashtra which says Personnel / HR Manager should be from Maharashtra who can speak Marathi.
However,
i. In industrial policy GR for Package Scheme of Incentives - 2013 there is a requirement of 80% local persons. This is applicable only if you are availing a package of incentive from GOM in developing regions.
ii. Appointment of Welfare Officer under the Factories Act, there is a requirement of knowing Marathi language.
iii. Employment Exchanges (Compulsory Notification of Vacancies) Act is applicable to you and you need to comply the provisions of this Act. Under this Act, there is no compulsion to fill up the vacancy through Employment Exchange but it is compulsory to intimate the vacancies to Employment Exchange and file quarterly and bi-annual return.
HR Fraternity can correct me if I am wrong.

Thanks for the prompt revert..Can I have any references (book/link) for the Employment Exchange Act as there is one more meeting with this inspector in coming week so want to be prepared for that.

You can get a Bare Act Book - Employment Exchanges (Compulsory Notification of Vacancies) Act in book stall where Law Books are available. If you are from Mumbai, you can approach Labour Law Agency - at Tardeo AC Market or at Labour / Indl. Court, Bandra or at Labour Commissiner Office, BKC. You can also get this book at Bapuji Book Depot at Parel.
