I want to know if, supervisiors, asst managers, managers are eligible for over time wages, if yes uneder which Act, rules etc. Are there any case law to justify
that managers are eligible or vise versa. Please this is urgent

Sir, Please help me. I went through ID Act, Factories Act, Karnataka S & E act. Does the definations of workmen or employee under Factories Act or S& E act include these above mentioned catagory level

Please try to understand. Overtime is given to the workers and not for the Managerial/Supervisory Staff. The Time Fixation is done mainly for those who are working hard and strenuous work and if they continue for more than certain time period, it will reduce their effectiveness, productivity and further it will lead to accident at workplace. To avoid such exploitation, the Government has made some stringent rules. But as the Managerial / Supervisory staff are qualified and their work is also not much bodily stressful, it will not make any damage to the company. Hence, the Overtime is designed for the workers.
While making such Acts, Rules & Regulations, government make it with some sense. But while implementing the same, it is being followed or not is in the hands of the authorities.
That's the reason the workers are given only with Bonus and the Managerial staff are not getting the bonus. In turn they are getting the ex-gratia for the period.

As per the Factories Act OT wages are to be paid to workers.As per this Act all employees except the following categories are workers.
1.Occupier and Manager as per Factory licence.
2.Persons defined and declared under sec 64 of the Act,if their monthly salary is above Rs 18000/-pm.

Mr Periwal,

I got Rs 18000/- from the same place where you got Rs 6500/-i e Payment of Wages Act 1936 which was amended w.e.f 12.09.2012 raising the wage ceiling from Rs 10000/- to Rs 18000/-.

Dear Jaya,
Its totally depend on company policy. Many company paid overtime to worker as well supervisor and above level also and some company paid to workers only.
But very few company are there who paid overtime to managerial level.
