Dear Sir/Madam,
In our company there are 50 employees, out-of these 50, 30 employees are outsourced from a manpower agency firm. these 30 employee\'s salary is less than 15000.one new employee joined in our company in July. now as per ESIC when will his contribution and benefit period start?? from which month the employee will start getting the benefit of ESIC?? and if the employee takes sickness leave for 7 days what should be done???

1) ESi code has to been taken as soon as you are having 20 employees
2) IF your organization already covered under ESI then the contribution has to be recovered & remitted to ESIC from employee's joining...

It will be more better if you also consult Employees' State Insurance Act, 1948 and Rules as well as Regulations framed thereunder. The Act as well as Rules/Regulations can be downloaded from the website of ESIC.
The payment of benefits under ESI Act, 1948 are automatic provided the the insured person is eligible and necessary registration and certification is obtained from the appropriate Branch Office of ESIC and ESI Dispensary.

You have not mentioned your place of operation and also whether you are a factory or non factory.
You have 50 employees including employees through outsourced agency. All the 30 employees engaged through outsourced agency are drawing salary less than Rs. 15000/- p.m.
To you, ESI Act is applicable. All the employees including employees through outsourced agency with gross up to Rs. 15000/- are to be covered under ESIS compulsorily. To cover the employees through outsourced agency under ESIS is your responsibility.
Now your question on contribution period and benefit period. There are two contribution periods and two corresponding benefit periods which starts three months after the closing of contribution periods. Generally cash benefits are linked with contribution. Certain benefits the IP is entitled to get from day one. You are requested to study this subject first and understand the concept. On this forum, we have discussed this issue several times.
