Hi,
I have been asked to leave by my organisation. Company has not given me any documentation for the same. I am not attending office since that day. It has been 2 months I have been following up with Company HR for the reason behind this but there is no response from them. Follow up is going on via emails. I have received my salary for working days.
HR dept.is forcing me to put down the papers without any reason & telling me that they will terminate me if I don't resign. This has been told me over the phone. I am worried about my bonus, PF, & relieving letter.
Please advise me on this.

Sorry to state that without any documentation you have stopped attending your office, and now you want the forum to help you after 2 months.
It is the prime responsibility of the HR to give you the reason for your termination whatsoever, now since you want to start afresh/move on with your career you will require relieving letter, if the company issue you a termination letter may spoil your career. No one can stop your PF since that is paid from the PF Department. With regards to Bonus, please let us know whether the same is part of CTC or as per Bonus Act. In both cases you are eligible for the payment.
Last but not the least it is always advisable to sit across the table and sort out the issues amicably and exit smoothly.

Dear Saji,
Thank you for the immediate prompt.
Bonus clause is mentioned in the employment agreement. It does mention about bonus act. Please advise me if I should resign or ask company to provide me with the reason. I am yet not terminated but HR wants me to resign so that they can provide me with the relieving letter. I have not received any documentation from the company.

If it is as per Bonus Act and if your salary is within the eligibility you will get the Bonus during Diwali. With regards to resignation it is advisable to not to dig the dead body out put your resignation and take the relieving and Full and Final Settlement and exit smoothly. If you ask for the reason they may have ample reasons to terminate wherein you will spoil/waste your time/energy and your career. They now can easily terminate you sending a letter with job abandoned. Try to speak to your HR and your line manager to ascertain what went wrong so that you can overcome the same for your future.
All the best for your future endeavor

Your feedback appreciated. I have worked their for close to one year. Bonus should have been received at Diwali but they did not give to anyone as company's financial condition was poor. Salary was also used to delay. I am quite skeptical about it. But, seriously speaking this company has the weirdest policies I have ever come across.
I was not eligible for single leave till I complete 240 working days...company made us work on govt. holidays. Nothing was lawful. There was no proper employment agreement. My appointment letter itself was a so called agreement which does not mention anything about "Employment agreement."
Anyway....thanks for the help !!!

If your company has started recently i.e. within a span of less than 5 years, they are exempted from giving Bonus.

Hello Corporate Live,
While Saji have covered all the points that would lead to your getting out of this Company settle down in another job ASAP, I would only REITERATE what he mentioned: 'If you ask for the reason they may have ample reasons to terminate wherein you will spoil/waste your time/energy and your career'.
Like the saying goes: "You have only ONE reason to do the right thing, but A THOUSAND to do the wrong thing".
Just don't waste your time & effort, which would be better off to be put to use in your new job--especially since you say this Company has financial problems. Even if you ask for Bonus [presuming you are eligible], what do you expect--except spending time running after courts? Had the money involved been considerable, then it's a different matter--you worked here for only 1 year.
Just resign--as their HR insists--collect all your dues & Docs & move ahead.
All the Best.
Rgds,
TS
