Hi@Good evening!!
I wish to know if any employee (myself) is eligible to take leave 5 to 10 days during delivery case of his wife in 5th month of his probation period (6 months) of job.
I love my wife so much and want to be with her during such critical period.
I'll be very thankful if you provide me a clear suggestion.

Please refer the Leave Policy of your company, and also speak to the HR with regards to your above mentioned query. The forum will not be able to help you out with sanctioning of your leave, it purely depends on the company policy and humanitarian ground. Worst come worst you can go for LWP/LOP.

Your Query : Availing Leave during Probationary Period



Position: Employees including Probationers apply for Leave of Absence arising out of Some Genuine Unavoidable Reason to attend to Important Duties of Personal Life as stated in your case. Such Leave is need-based and need favorable consideration. Such Leave fall in the Category of Casual Leave which is normally 1 or 2 Days. Any Progressive Modern Employers (Management) could verify he genuineness of a Cause for availing Leave as mentioned in the Application for Leave or proper information received from the Applicant.

There is no embargo in considering and granting Leave of Absence even Leave-without-Pay Case during Probationary Period.

You can convince your Employer ( Leave Sanctioning Authority) submitting Documents like Hospital Admission Slips.

After all, Humane Touch in Employer-Employee Relationship may not be in the First Place in some Organization yet it is far ahead of whatever comes next.

There is no statutory provision for paternity leave.However some organisations may grant it as a matter of their leave policy.Therefore you can go through your leave policy for this. B.Saikumar

It would be a bad idea to take unauthorised leave during probation period.
You need to personally approach both your HR and your reporting superior with an application for leave in connection with your wife's delivery. You need to take their approval informally before submitting an official application.
Further, you should take leave only during the actual delivery and perhaps one day later, unless you have no one at home to look after her during the immediate post-delivery period. The concept of asking for paternity leave is not looked on kindly in Indian scenarios

Thanks Pon for this update.It appears the service rules of govt. employees provide for it. I understand that the central government employees too enjoy paternity leave.However in respect of industrial employment either in private sector or public sector, there is no statute on the lines of the Maternity Benefit Act granting paternity leave.hence it is left to be the matter of contract so far as industrial employment is concerned.
