Dear All,
Our is a start-up IT Company, currently 21 employees are working here (Delhi) and very soon we will start another branch in another city (chennai), all employees have salary more than 15000/-. We have now started deducting PF from all employees but no ESI. My question is, ESI is not mandatory if salary is more than 15000, than do we need to provide medical policy for all employees ? Even some employees don't want to get their PF deduction, so what should I do ? Form-13 or so. Kindly advice, I don't have any experience in Generalist profile, I only worked in recruitment, but here I m the only single person here.

Hi Priya
As far as ESI is concerned if the gross is above 15000/- the ESI is Exempted.
But for PF even though Gross is Above 15000/- if Basic & DA is lesser than 6500/- then PF s mandatory. If basic + DA is above 6500/- then if you are planning for PF newly then those employee's shall be exempted. In any chance already they have PF & due to increment or promotion if their basic is increased over & above 6500 then the contribution is mandatory & it is limited to 6500/-
Form 11 is A declaration form where in you should maintain for all employees who are getting basic above 6500/-

Dear Priya
Your orgnisation applicable for ESI PF registration whether you your all stafff getting salary over covering esi pf you have to get registration done after that you may comply Rs.7/- in pf and nil in esi.
