whether a trust body which employs 20 or more security guards for maintenance of a eco garden which has a specific entry fee is bound to pay minimum wages under the MW Act 1948?
From India, Kolkata
Why not? Trust is only the constitution of the board of directors or the owners but under the trust they are employing employees for doing some remunerative or profitable business/ activity. If it is to make trusts free from statutory obligations, all business would be run under a trust, nobody would go for registration under Companies Act or Partnership Act. Wherever workers are engaged, there should be followed all the labour laws. Certainly, in certain laws the application is limited to such establishments having a minimum number of employees, but for applicability of minimum wages the number is not a matter.
