Dear Frends please provide me some information:-

My elder bro. got expired on duty in road accident in our hometown in Punjab as he was working as a Field sales officer in a Mumbai Based Pharma company, registred in NSE.

He joined the company on 01 jan 2010 and expired on 18th may 2013.

at the time of joining he nominated the father as nominee and on 25 sept. 2012 he got married. his total service was 3.4 years.

I have submitted the FIR, Post Martem, Death certificates whatever company demands.

now company HR executve told me to send a declaration from the head of the family on a blank paper duly signed by father i.e to father stating that he himself declare that mother and wife will be the nominees for all the legal settlements like PF, Pension, Gratuity, EDLI, Accidental Claim, Full and Final settlement with company.

Please tell me is P.F and Pension is compulsory benefit to wife

And wat about EDLI?

What is this accidental Claim and Full and final settlement with company.

do we have any choice where the mother can alone take the benefits.

and what about the Father as a nominee which my brother has mentioned in company at the time of joining the organization.

do we can insert the father as a nominee with the wife and mother?

Also in the mean time many employees of the company contribute their financial support to us on the company web portal where the option was given to contribute willingly and accordingly the amount was deducted from the individual salary and they all got collected a amount of 12 lakhs and company HR madam came to our house few days back and give 02 checks of 06 lakhs each for mother and wife and also she went to our concern sbi branch and convert this amount to FD for 05 years.

But this is employees contribution, she told to our family and gave a letter mentioning this thing.

is this final from company?

What is the ESI?

That was also deducted from my brother salary right from the joining

and there is no talk of ESI at all.

One thing more, is this, we/our family are not doing any processing in this process, everything whatever it is PF, EDLI, CLAIM etc. is operating fromcompany head office at mumbai. we have given the formalities of FIR etc to them.

is there anything where my family should be remain aware?

Designation my brother was FSO i,e Field Sales officer
in simple way u can say M.R (Medical Representative) as he was in a Pharma company
And about salary i dnt have any salary slip of 2012 & 2013, which i have is old ones of 2010-11
salary was around 25-30 thousand per month which was not exactly fix but variable as per expenses.
But basic was very less, even of the order of 7000 in the last salary drawn or may b less. I told the HR to give me the last three offical salary slips not the system generated

but i recieve a letter frm company that bcoz marriage of my brother, under some section of law wife is automaticaly bcomes the beneficary for Pf, Pension and EDLI

After marriage the Wife automatically becomes the legal heir and is a beneficiary of PF, with regards to the ESI, since your brother was drawing a Salary of 25-30 thousand per month in 2010-11, assuming his salary would have been increased to 30-35 thousand per month in 2013-14. He must have not covered under ESIC Act. Assuming his variable pay will be equivalent to his Gross Salary. So check with the HR whether he was covered under ESIC or not.
If your brother was not covered under ESIC, the company must have insured him for his medical as well as accidental policy, please check that too with the HR and confirm back to the forum to give you appropriate replies. If your brother is covered under Insurance Policy than the Insurance Company is also entitled to compensate your family for the death.

It is unlikely that he was a member of ESI scheme
He is not eligible for gratuity.
The letter from the Co shows that he was EPF member. After having family an EPF member is supposed to give fresh nomination in favour of family members.If it is not done check with PF office or Co HR to know whether in the earlier nomination he has certified that his father/mother was dependent on him.If yes they can obtain a heirship certificate from court.Otherwise they or brother will not get any benefit.
